Planning Permission in Ireland Explained

One of the first questions we're often asked is, “do I need planning permission for my project?” If you're considering building, demolishing, extending, or renovating a property in Ireland, seeking professional advice on the planning process is critical. Sound advice, early in a project, can save a huge amount of time, money, and stress.

When is planning permission required? 

In general, planning permission is required for any development of land or property, unless the development is specifically exempted. Development includes;

  • Carrying out works (building, demolition and/or alteration) on, in, over or under land or buildings

  • Making material (i.e. significant) changes to the use of land or buildings (e.g., turning a garage into a separate dwelling, or, a creche into a restaurant).

Specific minor developments are exempt from the requirement of planning permission. These are outlined in the Planning and Development Act 2000, as amended. For example, some rear domestic extensions, under 40 square metres, can be built without formal planning permission but they must still comply with the building regulations and other planning conditions, such as, height restrictions and rear garden size. However, exempted development status may not apply to Protected Structures or properties in an Architectural Conservation Area, so it always best to check with a professional at the beginning of a project.

Failure to obtain planning permission, where it is required, can result in penalties.

What does a planning application involve?  

Applying for planning permission involves submitting documentation to the local council online, erecting a site notice at the property and publishing a newspaper advertisement. The submitted documentation includes, but is not limited to, a Tailte Éireann map, detailed drawings of the project, a copy of the site and newspaper notice, application forms and a cover letter outlining how the design complies with the local development plan. Typically a decision on a permission application is made within 8 weeks of the submission date, with a further 4 weeks allowed for appeals, taking the total typical timeframe to 12 weeks.
